This contract establishes the agreement between My Tam Travel (referred to as the Lessor) and the Renter for the use of a vehicle along with the services of a professional driver. It defines the roles, responsibilities, and terms agreed upon by both parties, ensuring a seamless rental experience
1. PARTIES INVOLVED
Renter: The individual or organization renting the vehicle and driver services.§
Lessor/Rental Company: My Tam Travel, the provider of the vehicle and driver services.§
Driver: If different from the renter, the individual authorized by My Tam Travel to operate the vehicle.§
2. VEHICLE DETAILS
Make, Model, and Year: Detailed in the agreement.
Vehicle Identification Number (VIN): Provided in the contract.
Special Features or Equipment: Includes any additional accessories or features (e.g., GPS, child seat).§
3. RENTAL PERIOD AND USAGE
Rental Period: Start and end dates and times are clearly specified in the agreement.
Mileage Limits: Agreed-upon mileage limits (if applicable).
Permitted Use: The vehicle may only be used for personal or business purposes as agreed.
Usage Restrictions:
No off-roading.
No illegal activities or transporting prohibited goods.
No subleasing or assigning the vehicle to another party.§
4. DRIVER'S RESPONSIBILITIES
The renter and authorized driver agree to:
Comply with all traffic laws and regulations in Vietnam.
Take proper care of the vehicle during the rental period.
Return the vehicle at the agreed-upon location and time in the same condition as received.
Inform My Tam Travel immediately in case of any issues, accidents, or damage to the vehicle.
Follow any specific instructions or guidelines provided by My Tam Travel or the driver.§
5. PAYMENT AND FEES
Rental Rate: Stated as per day, week, or other agreed period.
Additional Fees:
Airport pickup/drop-off: Additional charges as specified.
Extra mileage: Fees for exceeding mileage limits.
Late return: Fees for returning the vehicle beyond the agreed time.
Security Deposit: If applicable, refundable upon proper return of the vehicle.
Payment Methods: Cash, bank transfer, or other approved methods.§
6. INSURANCE AND LIABILITY
Insurance Coverage: Includes liability and collision damage waiver. Specific coverage details are outlined in the agreement.
Damage Responsibility: The renter is responsible for any damage caused to the vehicle beyond the insurance coverage.
Accidents or Injuries:
The renter must report accidents to My Tam Travel and the authorities immediately.
Insurance coverage exclusions, if any, will be detailed in the agreement.§
7. TERMINATION AND BREACH OF CONTRACT
Termination Conditions:
Either party may terminate the contract with prior notice.
The contract is automatically terminated if the renter violates its terms.
Breach of Contract:
Late return, unauthorized use, or misuse of the vehicle may result in penalties.
Any breach will require the renter to compensate My Tam Travel for damages or losses incurred.§
8. ADDITIONAL TERMS
Special Agreements: Any specific agreements between My Tam Travel and the renter will be documented in the contract.
Driver Behavior Restrictions: Drivers must maintain professional conduct and follow all safety guidelines.
Dispute Resolution:
Disputes will first be resolved through negotiation.
If unresolved, disputes will be referred to the competent court in Vietnam.§
