CAR RENTAL AGREEMENT

This Car Rental Agreement ("Agreement") is an inseparable part of the VEHICLE HANDOVER FORM ("Form") signed between the parties.

LESSOR (PARTY A): MY TAM TRAVEL TOURISM COMPANY LIMITED (MY TAM TRAVEL)
RENTER (PARTY B): (Information as stated in the Vehicle Handover Form)

With this agreement, Party A rents to Party B the vehicle specified in the Form for the agreed-upon period. Party B accepts and undertakes to use the vehicle under the agreed conditions (rental duration, return time, return station, etc.) and to pay the rental price completely and on time.

By signing this agreement, Party B assumes all liabilities related to the rental. Party B agrees that the address declared in the agreement is the legal notification address.

Party B confirms receiving the vehicle in good technical and cosmetic condition, with no damage or accident marks other than those described in the Vehicle Handover Form. Party B shall return the vehicle with all related documents, accessories, and the spare tire to Party A's office or another agreed-upon location.

ARTICLE 1: RENTAL CONDITIONS

1. Driver Requirements:
   • For economy vehicles: The driver must be at least 21 years old and hold a valid driver's license for at least 1 year.
   • For mid-size vehicles: The driver must be at least 24 years old and hold a valid driver's license for at least 2 years.
   • For premium vehicles: The driver must be at least 27 years old and hold a valid driver's license for at least 4 years.
2. Additional Driver: Any person other than Party B who drives the vehicle must be declared in writing to Party A and have their name recorded in the agreement. Otherwise, Party B shall be solely responsible for any direct or indirect damages caused to third parties.
3. Minimum Rental Period: The minimum rental period is 24 hours. Rentals for less than 24 hours will be charged as a full day.

ARTICLE 2: RENTAL PRICE AND PAYMENT

1. Rental Fee: Party B is responsible for paying the entire rental fee in advance, calculated according to Party A's current price list.
2. Other Costs: In addition to the rental fee, Party B must pay for:
   • Late Return Fee: If the vehicle is returned more than 2 hours after the specified time, Party B must pay an additional 1-day rental fee.
   • One-way fee (if applicable).
   • Fuel costs, toll fees, parking fees, and all other expenses arising during the use of the vehicle.
3. Payment Method: Party B may pay by credit card, cash, or voucher at the beginning of the rental period. A security deposit (equivalent to the initial rental fee and estimated costs) will be pre-authorized on Party B's credit card.
4. Late Payment Interest: In case of failure to pay the rental fee and other charges on time, Party B agrees to pay a late payment interest of 1.5% per month on the total overdue amount, calculated from the invoice date, without any further notice.
5. Traffic Fines: Party B is responsible for all traffic violation fines. If Party A has to pay these fines, Party B shall reimburse Party A in full, plus a service fee of 500,000 VND for each violation.

ARTICLE 3: PROHIBITED ACTIONS

It is strictly forbidden to sublease the vehicle or allow an unauthorized third party to use it, as well as to use the vehicle for the following purposes:

• By a driver not designated as an additional driver in the agreement.
• To tow or push any other vehicle.
• To transport passengers or goods for commercial profit.
• To participate in motorsports activities such as racing or speed trials.
• To drive on unsuitable terrain that exceeds the vehicle's technical and durability limits.
• To transport goods contrary to Vietnamese law or for illegal purposes, terrorist activities, or acts against the state.

Upon detection of any violation, Party B must immediately compensate Party A for any damages. Party A has the right to unilaterally terminate the agreement immediately.

ARTICLE 4: INSURANCE AND LIABILITY

1. Scope of Insurance: All compulsory and voluntary insurance for the vehicle is provided by Party A.
2. Cases Not Covered by Insurance: Party B accepts full responsibility to compensate for all vehicle damages in the following cases:
   • The driver is under the influence of alcohol, drugs, or other stimulants at the time of the accident.
   • Exceeding the speed limit or committing a serious violation of the Road Traffic Law of Vietnam.
   • Failure to obtain an accident report from the police or a valid on-site report.
   • Damage caused by a driver not registered in the agreement.
   • Other cases where the insurance company denies claims according to general insurance rules.
3. In Case of Theft: To benefit from theft insurance, Party B must prove that necessary precautions were taken by returning the vehicle key and registration certificate to Party A and reporting the theft to the police. Otherwise, Party B is liable for the full current market value of the vehicle and other damages not covered by insurance.

ARTICLE 5: RESPONSIBILITIES IN CASE OF AN ACCIDENT

In the event of an accident, Party B and any additional drivers must take the following steps:

• Take maximum precautions to ensure the safety of themselves, the vehicle, and third parties.
• Immediately notify the nearest police authority to create an official report of the scene.
• Collect the information of the other party (driver's license, ID, vehicle registration, insurance).
• Take photographs of the accident scene.
• Notify Party A immediately and provide all accident-related documents within 24 hours.

ARTICLE 6: LIMITATION OF LIABILITY OF PARTY A

1. Party A is not the vehicle manufacturer and is therefore not liable for any loss or damage arising from mechanical or manufacturer faults. Party A's liability is limited to delivering the vehicle in a safe driving condition and having performed periodic maintenance.
2. Party A is not responsible for the loss, damage, or theft of any property left in the vehicle.

ARTICLE 7: BREACH AND TERMINATION OF AGREEMENT

If Party B fails to comply with any provision of this agreement, especially failing to return the vehicle on time, Party B agrees that Party A has the right to repossess the vehicle from anywhere without prior notice or a court order. Party B must immediately pay for any damages and costs arising from Party A's repossession of the vehicle.

ARTICLE 8: GENERAL PROVISIONS

1. Any disputes arising from the implementation of this agreement shall be resolved through negotiation. If negotiation fails, the matter will be brought before a competent court in Vietnam for resolution.
2. The parties agree that all records, documents, audio/video recordings, and computer data of Party A shall be considered conclusive and sole evidence in the event of a dispute.
3. This agreement is made in two (02) copies of equal legal value, with each party retaining one (01) copy.
