After discussion and mutual agreement, both parties agree to enter into this self-drive car rental agreement under the following terms and conditions:

ARTICLE 1: SUBJECT OF THE AGREEMENT
1.1. Party A agrees to lease to Party B, and Party B agrees to lease one (01) automobile with the following details:

1.2. Vehicle Condition upon Handover: The vehicle is in good working condition, has been technically inspected, is clean, and comes with the following documents: Vehicle Registration Certificate (notarized copy), Certificate of Technical Safety and Environmental Protection Inspection, and Certificate of Compulsory Civil Liability Insurance.
1.3. Purpose of Rental: For personal and family travel purposes only. The vehicle shall not be used for any illegal purposes, such as racing, transporting prohibited or smuggled goods, or used as collateral, for mortgage, or pledge.

ARTICLE 2: RENTAL PERIOD AND HANDOVER LOCATION
2.1. Rental Period:

2.2. Pick-up/Return Location: At Party A's office or another agreed-upon location: [Specify address if different].

ARTICLE 3: RENTAL PRICE AND PAYMENT METHOD
3.1. Rental Rate: [Amount] VND/day.

* Late Return Fee: If the vehicle is returned later than the specified time, Party B shall pay the following surcharge:
* Under 3 hours late: A surcharge of [Amount] VND/hour.
* 3 hours late or more: Charged as one (01) full additional rental day.
3.4. Payment Method:
* Party B shall pay 100% of the total rental cost to Party A upon signing the agreement and receiving the vehicle.
* Payment shall be made in cash or via bank transfer to Party A's account.

ARTICLE 4: SECURITY DEPOSIT AND COLLATERAL
4.1. Security Deposit: Party B shall deposit a sum of [Amount] VND with Party A to secure the performance of this agreement. This deposit will be fully refunded to Party B after all costs have been paid and the vehicle has been returned in its original condition.
4.2. Collateral: Party B is required to leave one of the following as collateral:

* ☐ A motorbike (with its original registration certificate) with a value equal to or greater than [Amount] VND.
* ☐ Other valuable assets of equivalent value, as approved by Party A.
* The collateral will be sealed, stored securely by Party A, and returned to Party B immediately upon the termination of this agreement.

ARTICLE 5: RIGHTS AND RESPONSIBILITIES OF THE PARTIES

5.1. Responsibilities of Party A (My Tam Travel):

• To deliver the vehicle and related documents at the agreed time, location, and in the agreed condition.
• To be legally responsible for the origin and ownership of the rental vehicle.
• To purchase compulsory civil liability insurance and vehicle physical damage insurance (if applicable) as required by law.
• To instruct Party B on the basic functions of the vehicle.
• To receive information and provide support in handling incidents (accidents, technical failures) within its capacity.

5.2. Responsibilities of Party B (The Lessee):

• To provide complete and accurate personal documents (ID Card/Passport, valid Driver's License).
• To pay all rental fees in full and on time.
• To bear all costs for fuel, road tolls, parking fees, and any traffic violation fines incurred during the rental period.
• To use the vehicle for its intended purpose and to comply with the Vietnam Road Traffic Law. Not to carry more passengers than the vehicle's specified capacity.
• To maintain the vehicle and its equipment with care. To be liable for compensation in case of loss or damage to the vehicle's accessories or interior.
• Not to perform any repairs or replace any parts of the vehicle without the prior consent of Party A.
• Not to sublease the vehicle or allow any person not registered with Party A to drive it.
• Incident Handling: In the event of an accident or technical failure, Party B must remain calm, secure the scene (in case of an accident), and immediately notify Party A via the hotline [Company Hotline Number] and the nearest police authority to coordinate a resolution. All costs for repairs and compensation for damages (if any) will be determined based on the cause of the incident and the terms of the insurance policy.
• To return the vehicle at the agreed time and location with all documents and accessories. The fuel level upon return must be the same as when the vehicle was picked up.

ARTICLE 6: INSURANCE AND COMPENSATION FOR DAMAGES
6.1. The rental vehicle is covered by compulsory civil liability insurance.
6.2. In the event of an accident or collision causing damage to the vehicle, Party B is responsible for coordinating with Party A and the insurance company to complete the claim procedures.
6.3. Party B shall be responsible for paying any costs not covered by the insurance policy or the deductible amount as stipulated in the insurance contract (typically from [Amount] to [Amount] VND per incident).
6.4. If an accident is caused by Party B's fault (e.g., driving under the influence of alcohol or drugs, a serious traffic violation) and the insurance company denies the claim, Party B must bear 100% of the repair costs, damages, and other related expenses (including Party A's loss of business income while the vehicle is under repair).

ARTICLE 7: CONTRACT TERMINATION AND LIQUIDATION
7.1. This agreement shall automatically terminate once Party B returns the vehicle, pays all outstanding fees, and both parties have fulfilled their respective obligations.
7.2. Party A reserves the right to unilaterally terminate this agreement and repossess the vehicle immediately (without prior notice) if Party B is found to be in serious breach of its terms, such as using the vehicle for an improper purpose, illegally pledging/mortgaging the vehicle, or allowing an unauthorized person to drive it. In such cases, Party B will not be refunded the rental fee or the security deposit.

ARTICLE 8: GENERAL PROVISIONS
8.1. Both parties commit to strictly adhere to the terms set forth in this agreement.
8.2. Any disputes arising from this agreement shall first be resolved through negotiation and mediation. If a resolution cannot be reached, the matter shall be referred to the competent People's Court in [City/Province] for settlement in accordance with the laws of Vietnam.
8.3. This agreement is made in two (02) copies of equal legal validity, with each party retaining one (01) copy.

This agreement is effective from the date of signing.
